Terms and Conditions of Service

These are the rules, we’ve tried to make them as straight-forward as possible in order to make it easy to understand what your rights are, and what you agree to by using Balkan Wild (interchangeably “Balkan Wild” or “we”) These Terms and Conditions of Service (“Terms”) set forth the agreement between Balkan Wild and each user of our website (“Site”), and each user of our platform (the “Service”). For the sake of clarity when we refer to our Site, that is our website located at www.balkanwild.comn. When we refer to our Service, that is the service purchased for use by a network of users for the purposes of sharing information and facilitating communication and collaboration.
We have separate terms and conditions for persons and companies who are the purchasers our Service, but these rules are for you, the worker bees, the people who make enterprises go. By using the Site and/or the Service, you agree to be bound by these Terms. If you do not agree to these Terms, your use of the Site and the Service is unauthorized, and beyond the scope of our control. Our lawyer wants us to say, these are legally binding Terms, and along with our Privacy Policy and Rules of Use, exclusively govern our relationship with you, the user.

We may, in our sole discretion, modify these Terms. The 'Last Updated' date at the top of this Agreement will indicate when the latest modifications were made. As explained in the Privacy Policy, we use industry standard data protection protocols, and are ready, willing and able to assist you in accessing, reviewing, editing or, if it is your desire, deleting your personal data. We have also developed user friendly, and more importantly, easy to read, descriptions of how and why we use your personal information in order to optimize the Service, and your experience with it. At Honey our policy is to keep you in control of your information and we have a deep appreciation for the trust you put in us when you share your information across our Service. III. Age Requirements
While Honey loves people of all ages and believes that even the youngest of us can be creative, productive and innovative, there are still laws we all need to follow. In this case, if you are under the age of 13 years, please navigate away from the Site, and you are not permitted to use the Service.

You acknowledge that all materials on the Site and the Service, including the Site’s and Service’s design, graphics, text, sounds, pictures, software, modalities of operation, and other files, as well as the selection and arrangement thereof (collectively, “Materials”), are the property of Balkan Wild, or its licensors, and are subject to and protected by United States and international copyright and other intellectual property laws and rights. All rights to Materials not expressly granted in this Agreement are reserved to their respective intellectual property rights owners. Except as expressly authorized by this Agreement or on the Site, you may not copy, reproduce, distribute, republish, download, perform, display, post, transmit, exploit, create derivative works or otherwise use any of the Materials in any form or by any means, without the prior written authorization of Company or the respective intellectual property rights owner.

V. Play by the Rules
Along with these Terms and our Privacy Policy we have compiled Rules of Use which are the rules we ask all users of the Service to comply with in order to ensure that everyone has a safe experience with the Service. Violations of the Rules of Use are treated the same way as violations of these Terms. If you violate the rules of Use, we will have to restrict your rights to use the Service, and this will have a negative impact not just on you, but on your entire team and organization.

Balkan Wild does not monitor or control the content that users share across the Service and we cannot be responsible for any harm you might cause to yourself or others by sharing links to sites that may contain offensive material, malware, or other damaging content. Balkan Wild expressly disclaims any liability whatsoever for links or other material shared by users of the Service, whether it is shared with other users or with persons outside of the Service.

EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN THIS AGREEMENT, BALKAN WILD AND ITS AFFILIATES''' '''MAKE NO WARRANTY THAT (I) THE SITE WILL MEET YOUR REQUIREMENTS, (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SITE WILL BE CORRECTED. BALKAN WILD AND ITS AFFILIATES SHALL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF, IN CONNECTION WITH OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE, INCLUDING ANY LIABILITY (I) AS A PUBLISHER OF INFORMATION, (II) FOR ANY INCORRECT OR INACCURATE INFORMATION, (III) FOR ANY UNAUTHORIZED ACCESS TO OR DISCLOSURE OF YOUR TRANSMISSIONS OR DATA, (IV) FOR STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE, OR (VII) FOR ANY OTHER MATTER RELATING TO THIS SITE OR ANY THIRD PARTY WEBSITE. THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND YOU. THE INFORMATION AND SERVICES OFFERED ON AND THROUGH THE SITE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NOTWITHSTANDING THE FOREGOING, THE SOLE AND ENTIRE MAXIMUM LIABILITY OF BALKAN WILD AND ITS AFFILIATES FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OR CLAIM WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO BALKAN WILD ON THIS SITE.

THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF GOOD WILL, LOSS OF USE, LOSS OF DATA, COST OF PROCURING SUBSTITUTE GOODS, SERVICES OR INFORMATION, LITIGATION OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF AN INDIVIDUAL ADVISES OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND YOU. THE INFORMATION AND SERVICES OFFERED ON AND THROUGH THE SERVICE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.
BOTH USERS OF THE SITE AND THE SERVICE SHOULD KNOW THAT:
SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE EXCLUSIONS AND LIABILITY ARE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

VIII. The Fine Print

A. Survival. Sections I, III, IV, V and tis Section VI shall survive any termination of these Terms.

B. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its choice of law provisions. You agree to submit to personal jurisdiction in Bulgaria and further agree that any cause of action arising from or relating to the use of this Site or this Agreement shall be brought exclusively in the Federal or State Courts residing in Sofia, Bulgaria.
If you live outside of Bulgaria, then your use of the Site or the Service is also governed by the rules of the United Nations Convention on the International Sale of Goods, and you may have the right to bring any claims you may have outside of Bulgaria, as provided for in the UN Convention.
Balkan Wild makes no attempts to circumvent the rules of the regulatory programs it adheres to, such as Privacy Shield, or the General Data Protection Resolution as issued by the European Union, and enforced by the Information Commissioner’s Office, and to the extent you have the right to have your disputes heard in a tribunal as provider for in any regulatory regime, Balkan Wild agrees to be subject to those tribunals as well. C. Waiver of Jury Trial. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BALKAN WILD HEREBY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING OR LITIGATION BROUGHT AGAINST THE OTHER WITH RESPECT TO THIS AGREEMENT OR THE SITE. IN ADDITION, NEITHER YOU NOR COMPANY SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER SITE USERS OR LITIGATE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

D. Severability; Interpretation. If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, the validity and enforceability of any remaining provisions shall not be affected. When used in this Agreement, the term "including" shall be deemed to be followed by the words "without limitation."

E. Entire Agreement. These Terms, along with our Privacy Policy and our Rules of Use, constitute the entire and only agreement between Balkan Wild and each user of this Site with respect to the subject matter of these Terms and supersedes any and all prior or contemporaneous agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of these Terms. Use of the Service is also subject to these Terms, our Privacy Policy and our Rules of Use, as well as any contractual agreement we may have with the purchaser of the Service. If you are not the purchaser of the Service, you should consult with the authorized person within your organization to understand what rights or responsibilities may be imposed by our contract with them.
